Terms of Use
Last updated: March 2026 · BrickShare Ltd
Important: BrickShare is a regulated fractional real estate investment platform. Investment in property shares involves risk. Please read these Terms, our Privacy Policy, and Risk Disclosure carefully before investing.
1. Acceptance of Terms
By accessing or using the BrickShare platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. BrickShare reserves the right to update these Terms at any time, and continued use of the Platform constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and have legal capacity to enter into binding contracts. You must successfully complete our Know Your Customer (KYC) verification process before making any investment. By using this Platform, you represent and warrant that you meet these eligibility requirements.
3. Fractional Investment Structure
BrickShare enables fractional investment in real estate assets through the purchase of digital property shares ("Fractions"). Each Fraction represents a proportional beneficial interest in the underlying property asset. Fractions are not transferable outside the Platform except through the Secondary Market feature. BrickShare acts as the platform facilitator and does not provide investment advice.
4. KYC & Anti-Money Laundering
All users must complete identity verification, including submission of a valid government-issued ID and proof of address. We are required by law to conduct AML/KYC checks. BrickShare reserves the right to suspend or terminate accounts that fail verification or are associated with suspicious activity. All KYC data is handled in accordance with our Privacy Policy.
5. Investment Process
Investments are made by funding your BrickShare Wallet and subscribing to available property offerings. Fractions are allocated proportionally to subscription amounts. Once allocated, investments are locked for the property's stated holding period unless traded on the Secondary Market. Minimum investment amounts apply per property listing.
6. Returns & Dividends
Rental income generated by properties is distributed to Fraction holders on a quarterly basis, proportional to their holding. Returns are not guaranteed and depend on property occupancy, management performance, and market conditions. Past performance displayed on the Platform is not indicative of future results.
7. Secondary Market
BrickShare operates a secondary market allowing Fraction holders to list and purchase Fractions from other investors. Secondary market trades are subject to platform fees and market availability. BrickShare does not guarantee liquidity on the secondary market.
8. Fees
BrickShare charges the following fees: (a) a platform subscription fee on initial investments; (b) a secondary market trading fee on completed trades; (c) a property management fee deducted from rental income distributions. All fees are disclosed on individual property listings before investment.
9. Risks
Investment in property shares involves risk. The value of investments can go down as well as up. You may receive back less than you invest. Real estate markets are subject to regulatory, economic, and environmental factors beyond BrickShare's control. Please read our full Risk Disclosure document before investing.
10. Intellectual Property
All content, trademarks, and software on the Platform are the property of BrickShare Ltd. You may not reproduce, distribute, or create derivative works without explicit written permission.
11. Termination
BrickShare may suspend or terminate your account at any time for breach of these Terms, regulatory requirements, or at our sole discretion. Upon termination, outstanding investments remain in effect under the terms of the original property subscription until exit.
12. Governing Law
These Terms are governed by the applicable laws and regulations of the jurisdiction in which BrickShare Ltd is incorporated, and any applicable capital markets legislation. Disputes shall be resolved through binding arbitration in accordance with applicable rules.
